Pictorium Terms of Service

These are the rules for using Pictorium (the app, and the member website at https://pictorium.ca). By creating an account, joining a group, or uploading anything, you agree to them. If you do not agree, please do not use Pictorium.
Our Privacy Policy and Child Safety Standards are part of these terms.
1. What Pictorium is
Pictorium is a private place for a group of people — a team, a class, a wedding party, a camp — to share photos and short videos from an event. One person (the organizer) creates a group and hands out a six-character invite code. People who have the code (members) join and share. Nothing is public. There are no public links, no public profiles, and no advertising.
2. Who may use it
- You must be at least 13 years old to have an account, whether as an organizer or a member.
- Children under 13 must not have their own accounts. Parents and guardians share photos of their children; children do not sign in themselves.
- If you are under the age of majority where you live, you confirm a parent or guardian is okay with you using Pictorium.
- You must be able to enter into a binding agreement. If you are using Pictorium for an organization (a club, a school, a business), you confirm you are allowed to accept these terms for it.
If we learn that an account belongs to someone under 13, we will close it.
3. Your account
- You sign in with a passkey or a one-time link we email you. There are no passwords. Keep your email account secure; anyone who can read your email can sign in as you.
- Each phone or browser you sign in from gets its own device token. You can see and sign out of your devices in the app.
- You are responsible for what happens under your account. Tell us at support@pictorium.ca right away if you think someone else is using it.
- One person, one account. Do not make accounts for other people or share your account.
4. Organizers
If you create a group, you are its organizer. That means:
- You control who gets in. The invite code is the key to the group. Share it only with people who should see the photos. You can turn on "approve new members" so a code alone is not enough, and you can remove anyone at any time. Removed members cannot rejoin with the code.
- You control what gets shown. By default, every upload waits in your queue until you approve it, and other members cannot see it until you do. You can turn on auto-approve for your group; if you do, you are choosing to let uploads appear without a look first.
- You are the moderator. You can remove any photo, video, or comment in your group. When someone reports something in your group, you are expected to act on it promptly.
- You are the payer. If a group is on a paid tier, the organizer pays. Members never pay to join or view a group.
- You may not run a group for a purpose these terms prohibit (section 7), and you must not let your group be used to share content about children that their parents or guardians have not agreed to.
You may add other organizers. If you delete your account and you were the only organizer, your group is closed and permanently deleted after a short grace period (section 9).
5. Uploading: your responsibility for what you share
When you upload a photo or video, you are telling us that:
- You have the right to share it. You took it, or the person who took it is fine with you sharing it here.
- The people in it are okay with it being shared with this group. This matters most for photos of children. If a photo shows someone else's child, you must have their parent's or guardian's permission to share it, or a reasonable basis to believe they would agree (for example, a team photo at a game where everyone is taking pictures).
- It is appropriate for the group and does not break section 7.
Parents and guardians can ask for a photo of their child to be removed at any time by asking the organizer, using the in-app report, or emailing support@pictorium.ca. We will remove it.
You keep ownership of what you upload. You give Switch'N'Plugs permission to store it, make it available to the members of the group you put it in, and act on it as described in section 8. That permission ends when the photo is deleted, except for copies we must keep by law (section 8). We do not use your photos or videos for anything else — not for advertising, not for training software, not for promotion.
The app makes smaller copies of your photos on your phone before uploading them. On free groups only those copies are stored. On paid tiers the original file is stored as well.
6. Comments, likes, and views
- Comments appear as soon as you post them. Nobody screens them first — not us, not a computer. The organizer and the person who wrote a comment can remove it, and anyone can report it.
- You can like a photo. Likes move a photo up in the group; we never show how many likes anything has.
- We count how many times a photo has been viewed, without recording who viewed it. Counts below three are not shown.
7. Acceptable use
Do not use Pictorium to:
- Upload, post, or request any sexual content involving a minor, or any content that sexualizes a child. This includes "innocent" photos posted with a sexual comment or intent. See our Child Safety Standards.
- Contact, groom, or try to meet a child you do not have a legitimate relationship with.
- Share intimate images of anyone without their consent.
- Harass, threaten, bully, or impersonate anyone.
- Share photos of people who have asked you not to.
- Upload content you do not have the right to share, including content that infringes someone else's copyright.
- Share content that is illegal in Canada or where you live, or that promotes violence or hatred against a group of people.
- Try to guess invite codes, break into groups you were not invited to, scrape content, or interfere with the service.
- Sell, rent, or resell access to groups.
Organizers may set stricter rules for their own group.
8. Illegal content: what we do
How illegal content is caught. Pictorium does not scan your photos or videos against lists of known illegal images. What keeps a group safe is people: by default the organizer approves every upload before the group sees it, and anyone in a group can report a photo, video, comment, or person from inside the app. A report of illegal content goes to a person at Switch'N'Plugs, our designated safety contact, at safety@pictorium.ca.
If we learn of child sexual abuse material:
- The file is taken out of view at once. No one in the group, including the organizer, can see it.
- The file and the related account information are preserved as evidence. They are not deleted, even if you delete your account, for as long as the law requires.
- The uploader's account is frozen: no sign-in, no uploads, nothing published.
- We report it to the Canadian Centre for Child Protection (Cybertip.ca) and notify the police, as Canadian law requires, and cooperate with law enforcement.
- We do not tell the uploader, the organizer, or the group why an account was frozen or that a report was made. The law restricts that.
There is no in-app appeal. If you believe an account was frozen by mistake, the only route is to email safety@pictorium.ca. We will not restore an account or release a file while a report is open with the authorities.
Other illegal content. If we become aware of other illegal content, we will remove it, may freeze the account, and may report it to the police.
A note on the basic content flag. The app may attach a simple "possibly not safe for work" flag to an upload. Only the organizer sees it. It is a hint for the organizer's review, not a judgment, and it does not block anything on its own.
9. Reporting and blocking
- Report. Anyone can report a photo, a video, a comment, or a person from inside the app. Reports go to the group's organizer and to us. Reports are kept even if the reporter later deletes their account.
- Block. You can block a person. Blocking is mutual hiding: you will not see each other's photos or comments in any group, and neither of you is told. Organizers still see everything inside the groups they organize, so they can moderate.
10. How long we keep your photos, and when they are deleted
Retention is what you pay for. Groups keep their photos for a set time, based on the group's tier:

When a group reaches the end of its retention:
- The group is hidden and its photos can no longer be viewed or downloaded. This is the soft-delete window.
- Seven days later the group and every photo, video, and comment in it are permanently deleted from our storage. This cannot be undone. We do not keep backups of deleted media.
Before a free group expires we send the organizer reminders — about 7 days before and about 24 hours before — by push notification and email. Members can use "Save to my phone" to keep copies before then.
Upgrading a group extends its retention in place, keeping everything that is already there, and never shortens it: if the group already had a later date, it keeps the later date. This works during the seven-day soft-delete window too: upgrade and the group comes back.
Individual photos and comments can be deleted earlier by the person who posted them or by an organizer. The organizer can close or delete a group early.
11. Payments and refunds
Free groups are free. Paid tiers are bought by the organizer inside the app, through Apple's App Store or Google Play, at the prices shown in the app (in Canadian dollars, or your local equivalent, plus applicable taxes).
- Apple or Google is the merchant. They process the payment and hold your payment details; we never see your card.
- Refunds are handled by Apple or Google under their rules, not by us. Ask through the App Store or Google Play. We cannot issue refunds directly.
- Event passes are a one-time purchase for one group. The Organizer plan is a yearly subscription that renews automatically unless you cancel it in your App Store or Google Play settings at least 24 hours before it renews.
- If a subscription ends, groups on it keep their photos for 90 more days, then follow the deletion process in section 10.
- Prices may change. A change does not affect a pass you have already bought, and you will be told before a subscription renews at a new price.
12. Ending an account or a group
You can leave whenever you like. "Delete my account" in the app does the following, immediately:
- signs out every device;
- permanently deletes every photo and video you uploaded, in every group;
- removes your comments and likes;
- removes you from every group;
- closes any group where you were the only organizer (permanently deleted seven days later, so other members' photos are not destroyed the moment you tap the button);
- anonymizes your account record so it can no longer be tied to your email.
Files preserved as evidence under section 8, and reports you filed, are not deleted.
We can close your account if you break these terms, if we are required to by law, or if we shut the service down. If we close your account for breaking the rules, no refund is due. If we shut the service down, we will give organizers at least 30 days' notice to download their groups, except where the law prevents it.
13. Our service, as is
We work hard to keep Pictorium running and your photos safe, but we are a small company and we cannot promise perfection.
- Pictorium is provided "as is." We do not promise it will be uninterrupted, error-free, or that photos will never be lost. Keep your own copies of anything you cannot afford to lose. The "Save to my phone" feature exists for this.
- We are not responsible for what members upload or write. Organizers and uploaders are.
- We do not promise that the measures in section 8 will catch everything. We act on what is reported to us or what we otherwise learn of.
14. Limits on our liability
To the extent the law allows:
- Switch'N'Plugs is not liable for indirect, incidental, or consequential losses, lost profits, or lost data, however they arise.
- Our total liability to you for anything connected with Pictorium is limited to the amount you paid us in the 12 months before the claim, or CAD $100, whichever is greater.
- Nothing in these terms limits liability that cannot be limited by law, including for fraud or for death or personal injury caused by negligence.
Some provinces and countries do not allow some of these limits, so some may not apply to you.
15. Copyright complaints
If you believe something in a group infringes your copyright, email support@pictorium.ca with a link or description, what you own, and how we can reach you. We will pass a notice to the uploader and remove infringing content.
16. Governing law
These terms are governed by the laws of Ontario and the federal laws of Canada that apply there. Any dispute will be heard in the courts of Ontario, and you agree to that, except that nothing stops either of us from seeking an injunction anywhere or you from using the consumer-protection rights of the place you live.
17. Changes to these terms
We may update these terms. If a change matters, we will tell you in the app or by email at least 14 days before it takes effect. Using Pictorium after that date means you accept the new terms. If you do not, delete your account before the change takes effect. The current version is always at https://pictorium.ca/terms.
18. Other things
- If part of these terms cannot be enforced, the rest still applies.
- These terms, the Privacy Policy, and the Child Safety Standards are the whole agreement between you and Switch'N'Plugs about Pictorium.
- Apple and Google are not parties to these terms and have no responsibility for Pictorium. Apple and its subsidiaries are third-party beneficiaries of these terms as far as the iOS app is concerned and may enforce them.
- We may transfer this agreement if Switch'N'Plugs is sold or merges. You will be told if that happens, and your photos will still be governed by these terms and our Privacy Policy.
